Privacy Policy

Personal information is collected solely for the purpose of registering participants in our program. It will be used exclusively by Painted Horse and will not be shared with any third parties, in accordance with the Privacy Act 1988.  

The Practitioner will maintain confidentiality of the Client’s personal information and any details shared during sessions. However, the Client understands that confidentiality may be waived under certain circumstances, such as:

  • When disclosure is required by law (e.g., court order).
  • When there is a concern for the Client’s safety or the safety of others.

Terms & Conditions

Assumption of Risk

  • Participation in Equine Assisted Learning involves interaction with horses and may involve physical activity in an outdoor environment.
  • While all reasonable precautions are taken, working with horses carries inherent risks, including injury or unforeseen accidents.
  • The Client assumes full responsibility for any risks, injuries, or damages that may occur during participation in EAL sessions.

Horse Temperaments and Client Matching

  • Horses have individual temperaments and personalities, and their behaviour can vary.
  • All horses can be unpredictable, particularly when frightened, hurt, or mistreated.
  • Horses will be selected to ‘match’ the client’s experience and emotional state to ensure a safe and effective interaction.

 Exploring Boundaries

  • Horses naturally explore their environment using their bodies, which is why boundary-setting is essential.
  • Clients will be guided in the practice of setting personal boundaries and determining how they wish to engage with the horse during the session.

Safety Guidelines:

  • A practitioner will provide a safety guideline to clients, helping them understand how to make safe and conscious choices during sessions.
  • The safety guidelines will support both the client and the horse in maintaining a safe and respectful environment.

Practitioner Responsibilities

  • The practitioner is committed to taking all possible precautions to ensure the safety of both the clients and the horses.
  • Clear safety protocols will be followed to create a secure environment for all involved.

Client Responsibilities

The Client agrees to:

  • Attend scheduled sessions on time and notify the Practitioner in advance if they are unable to attend.
  • Follow the Practitioner’s instructions for safety and engagement during the sessions.
  • Be respectful of the horses and other participants.
  • Acknowledge that results from EAL sessions may vary depending on individual circumstances and goals.
  • Understand that EAL is not intended to replace medical or psychological care, and the Practitioner does not diagnose or treat medical or mental health conditions.

Code of Conduct

Participants agree to:

  • follow all safety instructions and guidelines provided by facilitators.
  • treat all animals, staff, and other participants with respect.

Aggressive, disrespectful, or unsafe behaviour will not be tolerated and may result in removal from the session without a refund.

Health and Medical Conditions

Participants confirm that they are physically and mentally able to participate in Equine Assisted Learning activities, and will disclose any medical conditions, allergies, or special needs that may affect participation.

In case of emergency, Painted Horse EAL facilitators are authorised to seek appropriate medical attention on the participant’s behalf.

Clothing and Footwear

  • Appropriate attire must be worn, including closed-toe shoes or boots and weather-appropriate clothing.
  • Failure to wear suitable clothing may result in my inability to participate in certain activities.

Limitation of Liability

  • The participant releases the facilitators, property owners, and all staff from any liability or claims for personal injury, damage, or loss incurred during participation, except where caused by gross negligence.

Scope of Services

The Practitioner agrees to provide EAL sessions which may include, but are not limited to:

  • Groundwork with horses
  • Equine-guided activities
  • Experiential learning exercises with horses to explore personal goals
  • Reflection and discussion following each session

The Practitioner will guide the Client in a safe and supportive environment, but the Client agrees to be an active participant in the process.

Confidentiality

The Practitioner will maintain confidentiality of the Client’s personal information and any details shared during sessions. However, the Client understands that confidentiality may be waived under certain circumstances, such as:

  • When disclosure is required by law (e.g., court order).
  • When there is a concern for the Client’s safety or the safety of others.

Payment Terms

  • The Client agrees to pay the amount per session as per the pricing schedule.
  • Payments are due 48 hours before the beginning of each session.
  • Payments may be made via Bank Transfer.
  • If the Client wishes to cancel a session, a 48 hour notice is required for a full refund.
  • If cancellation occurs in less than 48 hours, the session fee may be forfeited.

Termination of Agreement

The Agreement may be terminated at any time by either party with written notice. Upon termination, any fees owed for services rendered will be due.

Agreement Modification

Any modifications to the Agreement must be made in writing and signed by both parties.
